TERMS AND CONDITIONS These terms and conditions apply to all purchases made from the Futura Emporium, including both online purchases and those made by post, phone and fax. DISCLAIMER We make every effort to ensure that all the information about any product featured on our site is accurate, but we can't absolutely guarantee it. If we find out about any changes before we ship you the goods, we'll email you and let you know in case you want to change your mind. If we don't find out until afterwards, you can still exchange or return them in accordance with our Returns policy (see below). The information on the Site is provided 'as is' and 'as available'. It is for information purposes only and Futura Interactive Limited does not hold itself out as providing any advice or recommendation of whatsoever nature. Futura Interactive Limited shall, unless specifically stated otherwise, not be liable for any damages or loss arising out of or in connection with the use of the Futura Emporium web site or the purchase of products through it including (but not limited to) direct or indirect consequential loss, loss of data, income or profit, loss of or damage to property and claims of third parties. We reserve the right to modify any content, information or terms on our web site at any time and without prior notification, to take effect immediately on publication. Our most recent terms will always apply to any orders, even when you have placed orders before. You can see if the terms have changed from the date that is published at the foot of the page. All products are subject to availability. We may not always be able to accept an order, for example if we are out of stock, or if you have requested delivery to a country to which we are unable to deliver, or if we have reason to believe that there may be a problem with processing the payment for the order. If this is the case, we will contact you (by post, phone or email) to let you know as soon as possible. If for whatever reason we are unable to supply the goods you have ordered, we will reimburse any payment you might have made for the goods in full as soon as possible. This will be no later than 30 days of having originally accepted your order. PRICE & PAYMENT For general help and information see our Payments section. The price for the goods will be as specified on the Futura Emporium web site at the date and time at which you order them. The price does not include delivery charges which are extra, but does include VAT at the current rate in the UK where applicable. Any customs or import duties levied once the package reaches your country will be the responsibility of the customer as we have no control over these charges and cannot predict what they might be. We accept all major credit and debit cards, including Visa, MasterCard, Eurocard, Switch, Solo, Delta, JCB, American Express, Visa Electron and Laser. We do not currently accept Diners. All transactions are in pounds Sterling (£). We also accept orders paid by cheque if you prefer. Cheques should be made payable to Futura Interactive Limited. For security reasons orders cannot be despatched until your cheque has cleared. SECURITY All purchases are processed through Worldpay, an internationally-recognised and separate secure payment processing system affiliated to a major UK bank. Your credit or debit card information is encrypted before being securely transmitted over the internet, meaning that only we are able to decode it to obtain your personal details. For your security, none of your personal or card details are held on the website. Although this means that you will need to re-enter the information every time you order, it protects you from the possibility of someone else obtaining your details on a shared computer. In the event of unauthorised use of your credit or debit card, most banks and card issuers either wholly cover all charges incurred, or if they hold you responsible, may limit your liability to just £50.00. In the unlikely event that your credit or debit card is used fraudulently as a direct result of shopping with Futura Emporium, we will cover your liability up to £50.00, providing the unauthorised use is through no fault of your own. In the event of unauthorised use of your credit or debit card, you must notify your card provider in accordance with its reporting rules and procedures. DELIVERY For general help and information see our Deliveries section. The delivery of your order will usually be carried out directly by the people who produce the goods. Delivery services Small items delivered both within the UK and internationally will normally be sent via Royal Mail or ParcelForce using a trackable method. Larger or more fragile items may need to be delivered by courier. In the majority of cases these delivery charges are preset, and will be quoted and processed online at the same time as your order. For certain products we may require more specific information to calculate the delivery charge. These products will be marked as 'Call for Delivery' and will require you to contact us for a delivery quotation . If you have processed your order online prior to contacting us for a quotation, your payment will be deferred. This means that your card won't be charged for the goods until we've agreed the delivery cost. If you decide not to go ahead when we've quoted you the delivery, we can cancel the whole order in which case it will never appear on your statement. Alternatively you may choose to process your entire order over the phone when obtaining your delivery quotation. For courier deliveries we will contact you to arrange a convenient delivery time. A signature will be required for all deliveries. Despatch times Delivery despatch times will vary from product to product, as the fulfillment is dealt with by individual suppliers. You can find out specific depatch information by clicking on the 'View Selection' button under the item you wish to puchase. RESPONSIBILITY FOR THE GOODS You will be responsible for the Goods from the time when they are delivered to you. We will assume responsibility for the Goods while they are in transit so that if they are damaged on arrival under our returns policy we will replace them free of charge. To take advantage of our returns policy, you must, however, inform us within 3 working days of their being delivered to you that they are damaged. You can contact us on +44 (0)20 7608 1616. If they do not arrive at all we will also replace the Goods free of charge. RETURNS For general help and information see our Returns section. Unwanted goods Some of our products are made to order, which means that we cannot exchange or take back an item unless it is actually defective. If this is the case, we will let you know that the item is non-returnable before we process your order and endeavor to provide material samples when required. With all other products, we are happy to exchange for another Futura Emporium product or provide a full refund as required, if, when you receive your order you decide you don't want it. You must contact us within 3 days of receipt, using the Returns form, then return the item in perfect condition and in the original packaging within 30 days from the date of purchase. When returning items we strongly recommend you obtain proof of postage/delivery, as we can't accept responsibility for parcels lost in transit. We regret that you may be required to pay an additional delivery charge to cover costs incurred as a result of returning the item and sending out a replacement. Damaged or Defective Goods You must contact us within 3 days of receipt if items are damaged or defective on arrival, using the Returns form. Goods which have been damaged in transit, or don't work, or are different from the information given about them on the site, can be replaced at no cost with free delivery. If this is the case, please let us know by clicking the checkbox on the form. PRIVACY We follow strict security procedures, as required by the UK Data Protection Legislation regarding the storage and disclosure of any information given by you. Under these guidelines we offer our assurance of total confidentiality and promise that your details will not be disclosed to any to other companies other than to fulfill your order, in which case the minimal information will be supplied. Cookies Cookies are small pieces of data that are stored by your browser on your computer's hard drive. Futura Emporium does not use cookies other than to count the number of visitors to the site. We may temporarily use cookies for competitions or promotions, in order to limit individual's entry. Neither the cookies or the counters can be used to personally identify any individuals. Unsubscribe If you have selected to receive future updates, you will be emailed information about Futura Emporium products, offers & promotions from time to time. You can unsubscribe at any time by emailing us at feedback@futuraemporium.com and writing "unsubscribe" in the subject heading. We will not supply your email address to any third party. ILLEGAL USE You may only use the web site for lawful purposes. You must not illegally transmit, distribute or store any material or violate any applicable regulation. This includes, without limitation, material which is protected by copyright, trademark, trade secret or intellectual property right which you use without permission. In the interests of all our users, Futura Interactive Limited will co-operate with investigations by any law enforcement or relevant authorities of suspected criminal activity or violation of systems or network. GOVERNING LAW AND DISPUTES Any dispute arising in any way in relation to this web site shall be governed by English Law and any such dispute shall be referred to the English Courts. If any provision in these terms is found to be invalid by any court, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. Headings in these terms are for convenience only and will have no legal meaning or effect. INTELLECTUAL PROPERTY RIGHTS Any intellectual property rights of whatever nature arising in respect of the name, brand, interface design, graphics, software, underlying source code and all other material (the 'Content') on the Futura Emporium website belong to Futura Interactive Limited or its licensers, all rights reserved. The copyright of all of the products within the shop belong to third parties.
